Settlement Agreements
In short — A settlement agreement records the terms on which employment ends, helps you avoid tribunal proceedings and protects your business reputation.
A settlement agreement lets the business and an employee formally record the terms on which the employment relationship ends. For the employer, it helps to protect sensitive business information, client relationships and the reputation of the business after the employment relationship has ended. The employee usually agrees not to pursue specified claims, creating a clean break and reducing future uncertainty. To be enforceable, the agreement must meet strict requirements under the Employment Rights Act 1996 — generic, outdated or poorly drafted templates can leave your business exposed to ongoing legal risk.
We can help you with:
- Termination payments and their tax treatment, notice and holiday pay, bonus and commission, and return of company property
- Confidentiality, non-disparagement, reinforced restrictive covenants, and agreed references and future communications
- Achieving a clean exit and resolving issues privately and commercially, avoiding the cost, disruption and stress of tribunal proceedings
